AND TO EACH COMPONENT PART COMPRISING ITS CONTENT (TRADE MARKS, TEXT, IMAGES, VIDEOS, ILLUSTRATIONS, LOGOS, ETC.). RICH CAST OF CHARACTERS, ITS AFFILIATES AND/OR THE HOLDERS OF THE WEBSITE’S INTELLECTUAL PROPERTY RIGHTS ARE THE HOLDERS OF ALL INTELLECTUAL PROPERTY RIGHTS RELATING TO THE WEBSITE AND TO ITS COMPONENT PARTS.

ON THIS BASIS AND IN ACCORDANCE WITH APPLICABLE INTELLECTUAL PROPERTY LAW, USE OF THE WEBSITE AND ITS COMPONENT PARTS IS AUTHORISED FOR PRIVATE USE ONLY.

THE TRADE MARKS BELONGING TO RICH CAST OF CHARACTERS AND/OR ITS AFFILIATES FEATURED ON THE WEBSITE ARE TRADE MARKS REGISTERED IN THAILAND AND/OR INTERNATIONALLY FOR VARIOUS PURPOSES BY RICH CAST OF CHARACTERS AND/OR ITS AFFILIATES. THE TOTAL OR PARTIAL REPRODUCTION OR REPRESENTATION OF THESE TRADE MARKS PERFORMED FROM THE WEBSITE OTHER THAN WITH EXPRESS PRIOR CONSENT FROM CELINE IS PROHIBITED, IN ACCORDANCE WITH THE PROVISIONS OF APPLICABLE INTELLECTUAL PROPERTY LAW.

 

SIMILARLY, ANY USE MADE OF ALL OR PART OF THE WEBSITE’S CONTENT FOR ILLEGAL PURPOSES RENDERS THE USER LIABLE UNDER CIVIL AND CRIMINAL LAW, AND SUCH USER MAY BE THE SUBJECT OF LEGAL PROCEEDINGS.

 

RICH CAST OF CHARACTERS HAS THE RIGHT TO MODIFY THE CONTENT OF THE WEBSITE AT ANY TIME AND WITHOUT NOTICE.

EXPRESS PRIOR AUTHORISATION MUST BE OBTAINED IN WRITING FROM RICH CAST OF CHARACTERS FOR THE CREATION OF HYPERTEXT LINKS TO ANY ONE OF THE PAGES OR COMPONENT PARTS OF THE WEBSITE. THIRD PARTY WEBSITES CONTAINING HYPERTEXT LINKS TO THE WEBSITE ARE NOT UNDER THE CONTROL OF RICH CAST OF CHARACTERS AND RICH CAST OF CHARACTERS THEREFORE DECLINES ALL LIABILITY (PARTICULARLY AS PUBLISHER) CONCERNING ACCESS TO, AND THE CONTENT OF, SUCH WEBSITES.

 

THE WEBSITE MAY ALSO CONTAIN LINKS TO THIRD PARTY WEBSITES NOT PUBLISHED OR CONTROLLED BY RICH CAST OF CHARACTERS SUCH LINKS ARE PROVIDED AS A CONVENIENCE ONLY. YOU HEREBY UNDERTAKE NOT TO A) USE OR ALLOW THE USE OF THE WEBSITE IN AN IMPROPER MANNER, FOR UNLAWFUL, FRAUDULENT OR MALICIOUS PURPOSES, AND PARTICULARLY (WITHOUT LIMITATION): (I) BY PIRATING THE WEBSITE OR BY INTRODUCING ANY MALICIOUS CODE, INCLUDING VIRUSES, OR HARMFUL DATA INTO THE WEBSITE OR ANY OPERATING SYSTEM; (II) BY THE USE OF A “SPIDER” OR ANY OTHER SYSTEM, METHODS OR PROGRAMMES (AUTOMATED OR OTHERWISE) TO EXTRACT DATA OR INFORMATION FROM CELINE’S WEBSITE OR SERVERS; (III) BY SENDING OR STORING DOCUMENTS CONTAINING VIRUSES, WORMS, TROJAN HORSES OR OTHER HARMFUL CODE, FILES, SCRIPTS, AGENTS OR COMPUTER PROGRAMMES; (IV) BY INTERFERING WITH OR CAUSING HARM TO THE INTEGRITY OR PERFORMANCE OF THE WEBSITE AND THE DATA CONTAINED THEREIN; (V) BY TRYING TO OBTAIN UNAUTHORISED ACCESS TO THE WEBSITE, ITS SYSTEMS OR ASSOCIATE NETWORKS; (VI) BY TRYING TO ACCESS THE ACCOUNTS OR PERSONAL INFORMATION OF OTHER USERS IN AN UNAUTHORISED MANNER.

 

 

4. LIMITATION OF LIABILITY

SUBJECT TO THE SPECIFIC PROVISIONS APPLICABLE TO ON-LINE SALES AND TO CONSUMER LAW, RICH CAST OF CHARACTERS WILL UNDER NO CIRCUMSTANCES HAVE ANY LIABILITY WITH REGARD TO YOU OR TO ANY THIRD PARTY FOR ANY DIRECT OR INDIRECT DAMAGE OF ANY KIND WHATSOEVER, WHATEVER THE CAUSE, ORIGIN, NATURE OR CONSEQUENCE THEREOF, ARISING FROM THE CONSULTATION OR USE OF THE WEBSITE. IN PARTICULAR, RICH CAST OF CHARACTERS PROVIDES NO GUARANTEE AS TO THE UNINTERRUPTED FUNCTIONING OF THE WEBSITE AND REFUSES ALL LIABILITY IN THE EVENT OF ACCESS TO THE WEBSITE BEING INTERRUPTED OR UNAVAILABLE, IN RELATION TO BUGS OR VIRUSES, TO ANY DAMAGES CAUSED BY FRAUDULENT ACTS PERPETRATED BY THIRD PARTIES (SUCH AS HACKING) CAUSING THE MODIFICATION OF THE INFORMATION PROVIDED VIA THE WEBSITE OR PREVENTING ACCESS THERETO. THE USER THEREFORE DECLARES THAT HE/SHE ACCEPTS THE CHARACTERISTICS AND LIMITS OF THE INTERNET. THIS PRESENT LIMITATION OF LIABILITY APPLIES TO THE FULL EXTENT AUTHORISED BY LAW.

 

 

5. MAINTENANCE, AVAILABILITY

RICH CAST OF CHARACTERS WILL MAKE ITS BEST EFFORTS TO MAINTAIN A REASONABLE LEVEL OF WEBSITE FUNCTIONALITY AND AVAILABILITY. RICH CAST OF CHARACTERS RESERVES THE RIGHT TO LIMIT ACCESS TO THE WEBSITE AND ITS USE BY THE USER AT ANY TIME AND WITHOUT NOTICE IN ORDER TO CARRY OUT MAINTENANCE WORK AND MAKE CHANGES TO THE WEBSITE. RICH CAST OF CHARACTERS MAY NOT BE HELD LIABLE IN THE EVENT OF ANY INTERRUPTION TO ACCESS CAUSED BY SUCH MAINTENANCE OR UPDATING OPERATIONS.

 

6. APPLICABLE LAW - DISPUTES

THESE GENERAL TERMS AND CONDITIONS OF USE ARE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THAI LAW, BUT CERTAIN SPECIFIC MANDATORY LOCAL RULES MAY APPLY.

1. About Us

The website www.richcastofcharacters.com (the “Website”) is operated by Rich Cast of Characters, solely owned by Piyaphan Boonphen, with its registered office at 46/36 VIA 31, Sukhumvit 31, Klongton-Nuea, Wattana, Bangkok 10110, Thailand.

Throughout these Terms and Conditions of Sale, “Rich Cast of Characters,” “we,” “us” and “our” refer to Rich Cast of Characters.

2. Agreement to These Terms

These Terms and Conditions of Sale apply to purchases made through the Website.

By placing an order, you confirm that you have read, understood and agreed to these Terms and Conditions of Sale and our Privacy Notice.

Please review these Terms before submitting your order and save a copy for your records.

Nothing in these Terms limits any consumer rights that cannot legally be excluded under applicable law.

3. Products

Rich Cast of Characters creates handcrafted footwear and accessories. Most products are produced on a made-to-order, pre-order or limited-production basis.

Because our products are handcrafted and may use natural materials, minor variations in colour, texture, grain, markings, stitching and finishing may occur. These variations are part of the individual character of the product and are not considered manufacturing defects.

We make reasonable efforts to display product colours and details accurately. However, colours may appear differently depending on your screen, device settings and lighting conditions.

Product packaging, labelling and minor design details may occasionally differ from the images displayed on the Website without materially affecting the product.

 

4. Placing an Order

To place an order, you must select your product, size and any available options, add the product to your shopping cart and complete the checkout process.

You are responsible for checking that all information provided—including your selected product, size, colour, delivery address and contact details—is correct before submitting your order.

After your order is placed, you will receive an email acknowledging the order. The acknowledgement email does not necessarily mean that the order has been accepted.

Your order is accepted when we send you an order confirmation or notify you that production has begun.

We reserve the right to decline or cancel an order before acceptance where:

  • the product is unavailable;

  • the payment cannot be verified or processed;

  • the information provided appears inaccurate or incomplete;

  • we reasonably suspect fraudulent or unauthorised activity;

  • an incorrect price or product description was displayed; or

  • the order appears to have been placed for unauthorised commercial resale.

Where payment has already been taken for an order that we cannot accept, the amount paid will be refunded using the original payment method.

 

5. Prices and Payment

Product prices are displayed in the currency shown on the Website or at checkout.

Delivery charges and any taxes or other charges collected by us will be displayed before you submit your order.

You may pay using the payment methods available at checkout. Payment is charged in full when the order is placed.

Payments may be processed by third-party payment service providers. By submitting your payment details, you authorise us and our payment service providers to charge the total amount shown at checkout.

Your bank or card provider may charge foreign-transaction, currency-conversion, cross-border or other processing fees. These charges are determined by your provider and are not controlled by Rich Cast of Characters.

 

6. Production Time

Most Rich Cast of Characters products are handcrafted specifically for each order.

Unless otherwise stated on the relevant product page, the usual production time is approximately 4–6 weeks.

During sale periods, special releases, high-demand periods or for certain customised products, production may take approximately 4–8 weeks.

Production time is separate from delivery time.

All production timeframes are estimates. Although we will make reasonable efforts to complete your order within the estimated timeframe, delays may occasionally occur because of material availability, handcrafted production, order volume or circumstances beyond our reasonable control.

We will contact you if there is a significant delay affecting your order.

 

7. Delivery

Available delivery methods and charges will be displayed at checkout.

The delivery timeframe begins after your order has completed production and has been dispatched. Any delivery estimate provided by us or the carrier is an estimate only and does not constitute a guaranteed delivery date.

You are responsible for providing a complete and accurate delivery address. Rich Cast of Characters is not responsible for delays, additional charges or failed delivery resulting from incorrect or incomplete information provided by you.

Different products within the same order may be dispatched separately.

Delivery is considered complete when the order is delivered to:

  • the delivery address provided at checkout;

  • a person authorised to receive it on your behalf;

  • a reception, mailroom or other authorised receiving location at the address; or

  • another location arranged directly between you and the carrier.

If delivery is unsuccessful, you are responsible for contacting the carrier promptly to arrange redelivery or collection.

 

8. Customs, Duties and Import Charges

International orders may be subject to import duties, customs charges, taxes, tariffs or handling fees imposed by the destination country.

Unless these charges are expressly included or collected at checkout, you are responsible for paying them directly to the relevant authority or delivery provider.

Rich Cast of Characters does not control these charges and cannot confirm their amount before delivery.

You are responsible for ensuring that the products you order may legally be imported into your destination country.

When placing an international order, you may be considered the importer of record and must comply with the laws and customs requirements of the destination country.

If an order is refused, abandoned or returned because import charges were not paid or delivery was not accepted, you may be responsible for the original delivery cost, return delivery cost, customs charges and other expenses incurred, to the extent permitted by applicable law.

 

9. Cancellations and Order Changes

Most Rich Cast of Characters products are handcrafted specifically for each order. Payment is collected in full when the order is placed, and production may begin shortly after the order is confirmed.

Please contact us immediately if you wish to request a cancellation or change.

Once an order has been confirmed and production has begun, it cannot normally be cancelled, refunded or changed. Any cancellation or amendment requested before production begins may be accepted at the sole discretion of Rich Cast of Characters.

Customised, personalised and specially commissioned products cannot be cancelled once production has begun.

Nothing in this section limits any cancellation, refund or other consumer right that cannot legally be excluded under applicable law.

10. Returns and Size Exchanges

Except where required by applicable law or where a product is faulty, Rich Cast of Characters does not accept returns or provide refunds for a change of mind.

We accept requests for a size exchange within 30 days of delivery, subject to the following conditions:

  • the exchange must be for the same product in the same colour;

  • only the size may be changed;

  • the requested replacement size must be available or capable of being produced;

  • each product may be exchanged only once;

  • the product must be unworn, unused, unaltered and undamaged;

  • the product must be returned in its original packaging;

  • all original tags, labels and accessories must remain attached or included; and

  • the original shoe box and packaging must not be damaged.

Please contact info@richcastofcharacters.com before returning a product. Products returned without prior authorisation may not be accepted.

We will inspect the returned product before approving an exchange. We reserve the right to refuse an exchange where the product does not meet the conditions above.

Unless the product is confirmed to be faulty, the customer is responsible for all costs connected with an exchange, including return delivery, delivery of the replacement product, customs duties and taxes.

 

11. Faulty or Incorrect Products

Please inspect your order promptly after delivery.

If you believe that a product arrived damaged, faulty, incomplete or materially different from what you ordered, please contact info@richcastofcharacters.com as soon as possible.

Please include:

  • your name;

  • your order number;

  • a description of the problem; and

  • clear photographs or videos showing the product and the issue.

Do not return the product until we have provided return instructions.

Where a product is confirmed to have a manufacturing defect or has been supplied incorrectly, we will offer an appropriate remedy, which may include repair, replacement or refund, depending on the circumstances and your rights under applicable law.

Where we confirm that the product is faulty, we will cover reasonable return and redelivery costs.

Damage caused by the following is not normally considered a manufacturing defect:

  • normal wear and tear;

  • improper use or storage;

  • failure to follow care instructions;

  • exposure to water, rain, excessive heat, direct sunlight, chemicals or food;

  • accidental damage;

  • alteration or repair performed by a third party; or

  • natural variations in leather, suede, fabric or other handcrafted materials.

Nothing in this section limits your statutory rights relating to faulty or misdescribed products.

 

12. Ownership and Risk

Ownership of the product passes to you after we have received full payment for the order.

Risk of loss or damage passes to you when the order is delivered to you or to a person or location authorised by you to receive it.

 

13. Personal and Non-Commercial Purchases

Products purchased through the Website are intended for personal use.

You may not purchase products for unauthorised resale, commercial distribution or other commercial purposes without our prior written consent.

We reserve the right to refuse or cancel orders that we reasonably believe have been placed for unauthorised resale.

 

14. Limitation of Liability

Nothing in these Terms excludes or limits our liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • breach of mandatory consumer rights; or

  • any other liability that cannot legally be excluded.

To the fullest extent permitted by law, Rich Cast of Characters will not be responsible for indirect, incidental or consequential losses arising from an order or use of the Website.

We will not be responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics, transport interruptions, customs delays, governmental actions, labour disputes, material shortages, internet failures or disruptions affecting payment or delivery services.

 

15. Website Availability

We make reasonable efforts to keep the Website and checkout available and functioning correctly.

However, we do not guarantee that the Website will always be uninterrupted, secure or error-free.

We may temporarily suspend or restrict access to the Website for maintenance, updates, security or technical reasons without prior notice.

 

16. Intellectual Property

The Rich Cast of Characters name, trademarks, logos, photographs, product designs, written content, graphics and other materials displayed on the Website are owned by or licensed to Rich Cast of Characters.

Website content may be viewed or downloaded for personal, non-commercial use only.

You may not reproduce, publish, distribute, modify, commercially exploit or create derivative works from Website content without prior written permission from Rich Cast of Characters or the relevant rights holder.

 

17. Personal Information

We collect and use personal information in accordance with our Privacy Notice.

Personal information may be shared with payment processors, delivery providers and other service providers where reasonably necessary to process payment, produce and deliver your order, prevent fraud, provide customer support or comply with applicable law.

 

18. Governing Law and Disputes

These Terms and Conditions of Sale are governed by the laws of Thailand.

Any dispute relating to these Terms or an order will be subject to the jurisdiction of the competent courts of Thailand, except where mandatory consumer-protection laws give you the right to bring proceedings in another jurisdiction.

Before beginning legal proceedings, both parties should make reasonable efforts to resolve the matter directly.

 

19. Changes to These Terms

We may update these Terms and Conditions of Sale from time to time by publishing a revised version on the Website.

The Terms that apply to your order are those in effect when your order is placed. Changes made afterward will not affect an order that has already been accepted unless required by law or agreed with you.
